Missouri Workers Compensation Attorney
Roskin & Hoffmann, LLC
Missouri Workers Compensation Laws allow for weekly checks for the rest of the injured employees life if they are permanently unable to work.
An injured worker is entitled to payments of weekly checks for the rest of their life if it is determined that he or she is unable to compete in the open labor market for a job, thus making them unemployable. When the person’s inability to work is solely from the injury that was sustained at work, the workers compensation benefits are to be paid by the employer/insurer. If the persons inability to work stems from multiple injuries, some that are from a distant past, then the State of MO and their setup Second Injury Fund is responsible for making weekly payments for the rest of your life. Permanent total disability workers compensation payments are determined based upon your average weekly wage. Whatever that amount is, up to a statutory limit, is the amount that you will receive for the rest of your life.
Even if you are injured and unable to compete in the open labor market, you are still entitled to medical treatment to cure and relieve any symptoms that you may have from your work injury. This workmans compensation benefit of medical treatment lasts as long as necessary in order to achieve this. Please do not forgo this work comp benefit in order to settle your case. Allow us to help you through this process as it usually requires a hearing (trial) in order to obtain these workers comp benefits for you. Since most employers and the second injury fund are usually unwilling to admit to permanent total disability, you will need an administrative law judge to order them to make these payments. To do this on your own would be nearly impossible and is almost never a good idea. There are so many steps that must be done in order to win at a hearing, that with no experience to rely on, a person would be silly to proceed alone.
At Roskin & Hoffmann, LLC we have brought numerous workers compensation cases through to hearing. During this time we have not lost one case. To be sure, we do not accept every case that walks through our door, nor do we try every case. But when we do we have been successful.
